This Statement covers our treatment of personally identifiable information (“Personal Information") that we gather when you are accessing or using our Website, App or Services. COLLECTED INFORMATION: Information collected when you register for the ServiceWhen you register for the service, we collect basic information about you such as your name, company name, address, email address, phone number(s), location, profession and interests. We also ask that you allow us collect certain additional information from other social network providers, such as Facebook, IMDB, LinkedIn and others. If you register for the Premium Services (as described in our terms of use) we will also collect credit card or other payment information from you. We collect data about the pages on our Website that you visit and how you use the Website, App and Service. We also collect data about how and when you access your account, including information about the device and browser you use, your network connection and your IP address, and how you interact with other users on the Service.This information is used to help improve the Service and your experience of using the Service, is logged to help diagnose technical problems, and to administer our Site in order to constantly improve the quality of the Service. We may also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.Technologies such as cookies, beacons, scripts and tags are used by us and our third party partners. Cookies: When you interact with the Hey Filmmaker Website and Services we strive to make that experience easy and meaningful. When you come to our Web site or use our Service, our Web server sends a cookie to your computer. Cookies are files that Web browsers place on a computer's hard drive and are used to tell us whether customers and visitors have visited the Site previously. If you click on a link to a third party website, such third party may also transmit cookies to you.Standing alone, cookies do not identify you personally. They merely recognize your browser. Unless you choose to identify yourself to Hey Filmmaker, either by responding to a promotional offer, opening an account, or registering for a free trial, you remain anonymous to Hey Filmmaker. USE OF YOUR INFORMATION: Hey Filmmaker uses the information that we collect to set up the Service for individuals and their organizations, to provide the Services and to continuously improve the Services. We may also use the information to contact customers to further discuss customer interest in our company, the Service that we provide, and to send information regarding our company or partners, such as promotions and events. Customers are invited to receive an email newsletter by providing an email address. Customer email addresses and any personal customer information will not be distributed or shared with any third parties. Separately, customers are also asked to provide an email address when registering for the Service, in order to receive a username and password. We may also email information regarding updates to the Service or company, and may send a Customer Newsletter. Again, email will not be distributed or shared and customers can opt out of receiving any communication by emailing privacy@HeyFilmmaker.com at the time it is distributed, or at the time any customer registers for the Service.Where your use of the Services arises as part of your engagement with a business client of ours, we will share your interaction with that business which occurs through the Service with that business client. Except for this disclosure or except as we explicitly state at the time we request information, or as provided for below, in our terms of service or any other separate agreement which you may enter into with us, we do not disclose to any third-party the information provided. 
THIRD-PARTY SITES: The Site and the Service may contains links to other web sites. Hey Filmmaker is not responsible for the privacy practices or the content of these other web sites. You will need to check the policy statement of these others web sites to understand their policies. If you access a linked site you may be disclosing your private information. It is your responsibility to keep such information private and confidential.

STORAGE LOCATION AND TRANSFER OF PERSONAL INFORMATION If you are located outside the United States, the information that we collect from you may be transferred to, and stored and processed at, a destination in the United States. By submitting information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this Statement.

SHARING OF PERSONAL INFORMATION WITH THIRD PARTIES Trusted Third Parties: We may from time to time employ other companies and people to perform tasks on our behalf and need to share your information with them to provide the Services to you. Unless we tell you differently, such third parties do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. This includes third party companies and individuals employed by us to facilitate our Services, including the provision of maintenance services, database management, Web analytics and general improvement of the Services, and businesses who engage our Services (to the extent provided for above). THE SERVICE: The Hey Filmmaker service is a social networking service designed for individuals active in the film industry community (the “Service”). In order to access the Service and start creating a profile or interacting with other users, you must be a registered user. You can use the Service from a computer or a personal mobile device if you have downloaded the Hey Filmmaker App. In order to register for the Service, you must provide certain personal information to us about you, including without limitation details of your Facebook profile. We require this information into to (i) provide the Service to you and others; and (ii) validate your identity. We will only use your personal information in accordance with the terms of our Privacy Policy www.Heyfilmmaker.com/PrivacyPolicy Content. All information, data, text, software, music, sound, photographs, graphics, video, messages or other materials, whether publicly posted or privately transmitted to the Service by viewers or users whether in forums or otherwise (“User Content”), is the sole responsibility of such viewers or users. This means that the viewer or user, and not Hey Filmmaker, are entirely responsible for all such material uploaded, posted, emailed, transmitted or otherwise made available by using the Service. Hey Filmmaker does not control or actively monitor User Content and, as such, does not guarantee the accuracy, integrity or quality of such content. Users acknowledge that User Content may be made publically available and no guarantee is given regarding the confidentiality of User Content. Users acknowledge that by using the Service, they may be exposed to materials that are offensive, indecent or objectionable. Under no circumstances will Hey Filmmaker be liable in any way for any materials, including, but not limited to, for any errors or omissions in any materials or any defects or errors in any printing or manufacturing, or for any loss or damage of any kind incurred as a result of the viewing or use of any materials posted, emailed, transmitted or otherwise made available via the Service. You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to Hey Filmmaker all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms of Use. You further agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to post the material and to grant Hey Filmmaker all of the license rights granted herein. You further agree that you will not submit to the Service any Content or other material that is contrary to the any guidelines published by Hey Filmmaker from time to time, or contrary to applicable local, national, and international laws and regulations.

LICENSE OF CONTENT: For clarity, you retain all of your ownership rights in your Content. However, by submitting Content to Hey Filmmaker, you hereby grant Hey Filmmaker a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Hey Filmmaker's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in video Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your videos from the Service. You understand and agree, however, that Hey Filmmaker may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable.
No endorsement. Hey Filmmaker does not endorse any Content submitted to the Service by any user or other licensor, or any opinion, recommendation, or advice expressed therein, and Hey Filmmaker expressly disclaims any and all liability in connection with Content. Hey Filmmaker does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and Hey Filmmaker will remove all Content if properly notified that such Content infringes on another's intellectual property rights. Hey Filmmaker reserves the right to remove Content without prior notice.

RESTRICTIONS ON USER CONTENT AND USE OF THE SERVICE: Hey Filmmaker reserves the right at all times (but will have no obligation) to remove or refuse to distribute any User Content and to terminate users or reclaim usernames. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce these Terms of Use, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect the rights, property or safety of our users and the public. 
In using the Service, Hey Filmmaker App and/or Service You shall not: copy any content unless expressly permitted to do so herein; upload, post, email, transmit or otherwise make available any material that: is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially or ethnically objectionable, encourages criminal behavior, gives rise to civil liability, violates any law, or is otherwise objectionable;You do not have a right to make available under any law or under a contractual relationship; infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party (including privacy rights); is or contains unsolicited or unauthorized advertising, solicitations for business, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or data or the Service or that of any users or viewers of the Service or that compromises a user’s privacy; orcontains any falsehoods or misrepresentations or create an impression that You know is incorrect, misleading, or deceptive, or any material that could damage or harm minors in any way; impersonate any person or entity or misrepresent their affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any material transmitted to or through the Service or impersonate another person or organization;  interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service or probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures;  intentionally or unintentionally violate any applicable local, state, national or international law or regulation; collect or store personal data about other users or viewers; license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Website or Hey Filmmaker App; modify, translate, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the Hey Filmmaker App or any software provided as part of the Service, except to the extent the foregoing restrictions are expressly prohibited by applicable law; access the Website, App or Service in order to (i) build a competitive product or service; or (ii) copy any ideas, features, functions or graphics of the Service; or register for the Service on behalf of a group or corporate entity.
You also agree not to access the Service in a manner that utilizes the resources of the Service more heavily than would be the case for an individual person using a conventional web browser. Notwithstanding the foregoing, operators of public search engines may use spiders or other bots for the purpose of creating publicly available searchable indices of the materials on this Service.

 

END USER LICENSE: Except for User Content, the Hey Filmmaker App, the Website, and the information and materials that it contains, are the property of Hey Filmmaker and its licensors, and are protected from unauthorized copying and dissemination by copyright law, trademark law, and other intellectual property laws. Subject to the terms of this Agreement, Hey Filmmaker grants you a non-transferable, non-exclusive, license to (a) use the Service for your use, and (b) download, install and use one copy of the Application on a mobile device that you own or control for your use (the “License”). The Hey Filmmaker App is licensed to you and not sold. Nothing in the Terms gives you a right to use the Hey Filmmaker or Hey Filmmaker names, trademarks, logos, domain names, and other distinctive brand features without our prior written consent. You shall not attempt to override or circumvent any of the usage rules or restrictions on the Service. Any future release, update, or other addition to functionality of the Website or Hey Filmmaker App shall be subject to the terms of these Terms.

PREMIUM SERVICE: Hey Filmmaker may offer a premium subscription service as part of the Service from time to time (“Premium Service”). The Premium Service may offer additional functionality or other benefits not generally available on the free service. You must subscribe for the Premium Service in order to gain access to the Premium Service. By subscribing for the Premium Service, you agree to pay all fees associated with the Premium Services, as set out on the Website and as may be updated by Hey Filmmaker from time to time. Your subscription to the Premium Service will automatically renew at the end of each subscription period, unless you cancel your subscription through the Service before the end of the current subscription period. The cancellation will take effect the day after the last day of the current subscription period, and you will be downgraded to the free Service. Any fees associated with the Premium Service will be automatically deducted from your payment card on any such renewal. Price changes for Premium Service will take effect at the start of the next subscription period following the date of the price change. As permitted by local law, you accept the new price by continuing to use the Premium Service after the price change takes effect. If you do not agree with the price changes, you have the right to reject the change by unsubscribing from the Premium Service prior to the price change going into effect. Please therefore make sure you read any such notification of price changes carefully. Feedback. If You provide Hey Filmmaker with any suggestions, comments or other feedback relating to any aspect of the Website, Hey Filmmaker App and/or Service ("Feedback"), Hey Filmmaker may use such Feedback in the Service or in any other Hey Filmmaker products or services (collectively, "Hey Filmmaker Offerings"). Accordingly, You agree that: (a) Hey Filmmaker is not subject to any confidentiality obligations in respect to the Feedback, (b) the Feedback is not confidential or proprietary information of You or any third party and You have all of the necessary rights to disclose the Feedback to Hey Filmmaker, (c) Hey Filmmaker (including all of its successors and assigns and any successors and assigns of any of the Hey Filmmaker Offerings) may freely use, reproduce, publicize, license, distribute, and otherwise commercialize Feedback in any Hey Filmmaker Offerings, and (d) You are not entitled to receive any compensation or re-imbursement of any kind from Hey Filmmaker or any of the other users of the Service in respect of the Feedback.

ADVERTISING: You acknowledge and agree that the Service may contain advertisements. If You elect to have any business dealings with anyone whose products or services may be advertised on the Service, You acknowledge and agree that such dealings are solely between You and such advertiser and You further acknowledge and agree that Hey Filmmaker shall not have any responsibility or liability for any losses or damages that You may incur as a result of any such dealings. You shall be responsible for obtaining access to the Service and acknowledge that such access may involve third-party fees (such as Internet service provider access or data fees). You shall be solely responsible for any such fees and also for obtaining any equipment that is required to access the Service. It is your responsibility to ascertain whether any information or materials downloaded from the Service are free of viruses, worms, Trojan Horses, or other items of a potentially destructive nature.

LINKS & THIRD-PARTY WEBSITES: The Service (including User Content) may contain links to other websites that are not owned or controlled by Hey Filmmaker. In no event shall any reference to any third party, third party product or service be construed as an approval or endorsement by Hey Filmmaker of that third party, third party product or service. Hey Filmmaker is also not responsible for the content of any linked websites. Any third-party websites or services accessed from the Service are subject to the terms and conditions of those websites and or services and You are responsible for determining those terms and conditions and complying with them. The presence on the Service of a link to any other website(s) does not imply that Hey Filmmaker endorses or accepts any responsibility for the content or use of such websites, and You hereby release Hey Filmmaker from all liability and/damages that may arise from Your use of such websites or receipt of services from any such websites.

UNDER NO CIRCUMSTANCES SHALL HEY FILMMAKER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY DAMAGES THAT RESULT FROM (I) YOUR USE OF OR YOUR INABILITY TO USE THIS WEBSITE, HEY FILMMAKER APP OR THE SERVICE, (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS, DATA, INFORMATION OR SERVICES, (III) ERRORS, MISTAKES, OR INACCURACIES IN THE MATERIALS ON THE WEBSITE, (IV) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND WHATSOEVER ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, ANY BUGS, VIRUSES, TROJAN HORSES, OR ANY OTHER FILES OR DATA THAT MAY BE HARMFUL TO COMPUTER OR COMMUNICATION EQUIPMENT OR DATA THAT MAY HAVE BEEN TRANSMITTED TO OR THROUGH THE WEBSITE OR HEY FILMMAKER APP, OR (V) ANY ERRORS OR OMISSIONS IN ANY MATERIAL ON THE WEBSITE OR ANY OTHER LOSS OR DAMAGE OF ANY KIND ARISING FROM OR RELATING TO YOUR USE OF THE WEBSITE. THESE LIMITATIONS SHALL APPLY EVEN IF HEY FILMMAKER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, HEY FILMMAKER’S LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) FIFTY U.S. DOLLARS ($50) OR (B) AMOUNTS YOU’VE PAID HEY FILMMAKER IN THE PRIOR 12 MONTHS (IF ANY)THE FOREGOING LIMITATIONS SHALL APPLY TO THE FULLEST EXTENSION PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

INDEMNIFICATION. YOU SHALL INDEMNIFY AND HOLD HEY FILMMAKER AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, AND EMPLOYEES, HARMLESS FROM ALL CLAIMS, ACTIONS, PROCEEDINGS, DEMANDS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES), INCURRED IN CONNECTION WITH ANY MATERIALS SUBMITTED, POSTED, TRANSMITTED OR MADE AVAILABLE BY YOU THROUGH THE SERVICE AND/OR ANY VIOLATION BY YOU OF THESE TERMS OF USE.

TERMINATION: Hey Filmmaker may, under certain circumstances and without prior notice, immediately terminate Your ability to access the Service or portions thereof. Cause for such termination shall include, but not be limited to, (a) breaches or violations of these Terms of Use or any other agreement that You may have with Hey Filmmaker (including, without limitation, non-payment of any fees owed in connection with the website or otherwise owed by You to Hey Filmmaker), (b) requests by law enforcement or other government agencies, (c) a request by You, (d) discontinuance or material modification to the website (or any part thereof), (e) unexpected technical, security or legal issues or problems, and/or (f) participation by You, directly or indirectly, in fraudulent or illegal activities. Termination of Your access to the Service may also include removal of some or all of the materials uploaded by You to the Service. You acknowledge and agree that all terminations may be made by Hey Filmmaker in its sole discretion and that Hey Filmmaker shall not be liable to You or any third-party for any termination of Your access to this Service or for the removal of any of the materials uploaded by You to the Service. Any termination of these terms of use by Hey Filmmaker shall be in addition to any and all other rights and remedies that Hey Filmmaker may have.

 

AVAILABILITY & UPDATES: Hey Filmmaker may alter, suspend, or discontinue the Service at any time and for any reason or no reason, without notice. The Website, Service and/or Hey Filmmaker App may be unavailable from time to time due to maintenance or malfunction of computer or network equipment or other reasons. Hey Filmmaker may periodically add or update the information and materials on the Service without notice. Security. Information sent or received over the Internet is generally unsecure and Hey Filmmaker cannot and does not make any representation or warranty concerning security of any communication to or from the Service or any representation or warranty regarding the interception by third parties of personal or other information. You are responsible for safeguarding the password that you use to access the Service and you are responsible for any activities or actions under your password. You agree to keep your password secure. Hey Filmmaker will not be liable for any loss or damage arising from your failure to comply with these requirements.

These Terms of Use, together with any privacy policy that may be published on the Service, constitutes the entire agreement between the parties relating to the Website, App and Service and all related activities. These terms of use shall not be modified except in writing signed by both parties or by a new posting of these terms of use issued by Hey Filmmaker. If any part of these Terms of Use is held to be unlawful, void, or unenforceable, that part shall be deemed severed and shall not affect the validity and enforceability of the remaining provisions. The failure of Hey Filmmaker to exercise or enforce any right or provision under these Terms of Use shall not constitute a waiver of such right or provision. Any waiver of any right or provision by Hey Filmmaker must be in writing and shall only apply to the specific instance identified in such writing. You may not assign the terms of use, or any rights or licenses granted hereunder, whether voluntarily, by operation of law, or otherwise without Hey Filmmaker’s prior written consent.
